Please read these Terms and Conditions ("Agreement") carefully before using the People Calendar App ("the App"). This Agreement sets forth the legally binding terms and conditions for your use of the App.
Acceptance of Terms
By downloading, installing, or using the App, you agree to be bound by this Agreement. If you do not agree to these terms, you may not use the App.
Use of the App
(a) Eligibility: You must be at least 18 years old or have the consent of a legal guardian to use the App.
(b) License: We grant you a non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
(c) Restrictions: You shall not modify, distribute, reverse engineer, decompile, or disassemble the App. You shall not use the App for any illegal or unauthorized purposes.
User Accounts
(a) Registration: In order to access certain features of the App, you may be required to create a user account. You must provide accurate and complete information during the registration process.
(b) Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
(c) Termination: We reserve the right to suspend or terminate your account at any time if we believe you have violated any provision of this Agreement.
Content
(a) User-Generated Content: You may contribute content, such as event details, descriptions, and comments, to the App ("User Content"). You retain ownership of your User Content, but grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, display, and distribute your User Content in connection with the App.
(b) Prohibited Content: You shall not submit any User Content that is unlawful, defamatory, obscene, harmful, or infringing upon the rights of others.
(c) Monitoring: We reserve the right to monitor User Content and remove any content that violates this Agreement or is otherwise objectionable.
Privacy
Your privacy is important to us. Our Privacy Policy governs the collection, use, and disclosure of your personal information. By using the App, you consent to the practices described in our Privacy Policy.
Intellectual Property
(a) Ownership: The App and all intellectual property rights associated with it are owned by us or our licensors.
(b) Trademarks: All trademarks, service marks, logos, and trade names displayed in the App are the property of their respective owners. You are not granted any rights to use any of these marks without the prior written permission of the respective owner.
Disclaimer of Warranty
The App is provided on an "as is" and "as available" basis, without any warranties of any kind, whether express or implied. We do not warrant that the App will be error-free or uninterrupted, nor do we make any representations regarding the accuracy or completeness of the content provided through the App.
Limitation of Liability
To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, damages for loss of profits, goodwill, data, or other intangible losses arising out of or in connection with your use of the App.
Modification and Termination
We reserve the right to modify, suspend, or terminate the App or any part thereof, at any time without prior notice. We may also modify this Agreement at any time by posting the revised terms within the App.
Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of Belgium. Any dispute arising out of or in connection with this Agreement resolved through good faith negotiations between the parties. If the parties are unable to reach a resolution, any legal action arising from this Agreement shall be brought exclusively in the courts of [Jurisdiction], and you hereby consent to the personal jurisdiction and venue of such courts.
Indemnification
You agree to indemnify and hold us harmless from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the App, your violation of any provision of this Agreement, or your violation of any rights of any third party.
Severability
If any provision of this Agreement is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions of this Agreement shall remain in full force and effect.
Entire Agreement
This Agreement constitutes the entire agreement between you and us regarding the subject matter herein and supersedes all prior or contemporaneous agreements, understandings, or representations, whether written or oral.
Waiver
Our failure to enforce any right or provision of this Agreement shall not be deemed a waiver of such right or provision.
